On 07-26-2006 at approximately 1628 hours, I responded to Lake Eola Park at Central Boulevard and Osceola Boulevard regarding a possible violation of the newly amended City Ordinance 18A (Parks and Outdoor Public Assemblies) concerning large group feedings in city parks.

Officers S. Dunlaps (11756), B. Licciarello (1898), B. Shanley (10963), and D. Alban (14608) responded as well. PIO [Public Information Officer] Sergeant B[arbara] Jones (4586) responded to provide statements to the media. OPD Audio/Visual Technician Jed Ackerman (15498) was on scene to video tape the incident and participants. Parks and Recreation employees Leornaldo [sic] Falcon and Peter Essaldana were also on scene.

Upon arrival at the park, members of the group "Food Not Bombs" were present. Also with the group was ACLU Representative George Crosley [sic] and businessman Sean Kane. I provided Crosley [sic] with a copy of the new city ordinance, and a map listing the alternative seating [sit] site at Sylvia Lane and Grace Street. Crosley [sic] indicated that the group dod not intend to violate the new ordinance and asked if it would be a violation to serve beverages in the park without a permit. Since the ordinance does not define the word food or specifically prevent serving only beverages, I contacted City Prosecutor Ken Hebert for clarification. Hebert advised that he was unsure and the issue would have to be addressed at a later time. I then informed Crosley [sic] that we were unsure if serving only beverages would violate the new ordinance.

We later observed members of Food not [sic] Bombs providing food from the rear of a vehicle legally parked at a parking meter on the north side of Central Boulevard. The group provided the trays and plates for the food inside Eola Park and had the recipients walk over to the vehicle to receive their food. Once the food was received, the recipients walked back into the park and ate at the picnic tables. Crosley [sic] asked me if this was a violation of the ordinance since they were not actually feeding the group in the park or from any adjacent areas to the park. I again contacted Hebert by phone and he advised he did not believe that was a violation of the ordinance. I passed that information on to Crosley [sic] who stated the group would then continue providing food in such a manner. The person providing the food from the back of the vehicle refused to give their information for this report.

Food not [sic] Bombs member Benjamin B. Markeson stated he did not know the next time the group would be hosting another feeding. Bernard [sic] also advised his group was taking responsibility for cleaning up the park after the feeding. No large group feeding permit was provided to Food not [sic] Bombs since it does not appear they violated the city ordinance. This report is for informational purposes.

Regarding the question of whether or not it was illegal for Food not [sic] Bombs to feed the dispensed food from the back of the vehicle that was legally parked on Central Boulevard, City Prosecutor Ken Hebert advised me it would not have been a violation of city ordinance if the parking spot where the vehicle was parked was not adjacent to the park. Legal will review.

On 08-02-2006 at approximately 1700 hours, Lieutenant J. Marchione (2961) and I responded to Lake Eola Park in reference to a possible violation of the newly amended city ordinance 18A (Parks and Outdoor Public Assemblies) concerning large group feedings in city parks. OPD video technician terry Gariepy (4725) also responded. Parks and Recreation employees Leornaldo [sic] Falcon (NOI) [no other information) and Peter Essaldana (NOI) were also present.

Upon our arrival members of the group "Food Not Bombs" parked a red unknown type minivan on the north side of West Central Boulevard, just west of Osceola Boulevard. We met with Adam (NOI), who was sitting in the van. The back of the van was open and had two large metal containers of food covered in tin foil. We asked Adam who was the spokesperson for the group. Adam agreed to speak with us. We explained the ordinance to Adam as well as other members who were near the van. We gave Adam a map, which highlighted the areas concerning the ordinance. Adam reviewed the map.

Also present were George Crosley [sic], a representative associated with the ACLU, and John Berry [sic], an attorney associated with the group. We provided Adam with a permit from Parks and Recreation. [Actually, no one from Orlando Food Not Bombs requested a permit, filled one out, signed one or accepted one from either the OPD or Parks and Recreation.] During this time we observed a total of 40 individuals, including 7 partcipants/servers of the group, who would come back to the back of the van for the feedings. The individuals would come approximately three at a time from Lake Eola Park. Once the individuals received their food some went back into Lake Eola, and others went around the corner.
